What is Industrial Design?
A patent is a bundle of rights that is granted by a government that provides the holder exclusive rights to make, sell, use and import products embodying a design for a period of time.
How can you secure an Industrial Design ?
Governments that design registrations usually require an application to be filed and the payment of fees. The application usually contains a set of drawings which illustrate the design for which exclusivity is sought.
What can prevent an Industrial Design registration from being granted?
The most common reason is that the application is directed to a design that is too similar to a design already known to the public.
What happens if someone steals your Industrial Design registration ?
No one can steal your design registration. If a third party carries on an activity that contravenes, or infringes, the rights granted by the registration [to make, use, sell and import products embodying the design], the rights holder can sue in the courts. Some countries will actively restrain the importation of goods at their borders. And many online vendors, such as Amazon, will take down the sites of infringers on request of design patent holders.
