FREQUENTLY ASKED QUESTIONS
What is a patent?
A patent is a bundle of rights that is granted by a government that provides the holder exclusive rights to make, sell, use and import an invention for a period of time.
How can you secure a patent?
Governments that grant patents usually require an application to be filed and the payment of fees. The application usually contains a set of claims, which define a technology for which exclusivity is sought and a technical description sufficient to teach the public how to practise the technology once the term of exclusivity ends.
What can prevent a patent from being granted?
The most common reason is that the application defines technology that is already known to the public.
What happens if someone steals your patent?
No one can steal your patent. If a third party carries on an activity that contravenes, or infringes, the rights granted by the patent [to make, use, sell and import the invention], the patentee can sue in the courts. Some countries will actively restrain the importation of goods at their borders. And many online vendors, such as Amazon, will take down the sites of infringers on request of patent holders.
